1. Terms of Service
1.1 Overview
These Terms of Service (“Terms”) govern your access to and use of the Mylo Hub mobile application and related services (collectively, the “Service”), provided by Barking Flea LLC, a New Hampshire limited liability company (“Barking Flea,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to (a) end users/consumers who browse, view, or claim offers, events, or news, and (b) merchants and municipalities who post offers, events, or news.
1.2 Eligibility & User Accounts
- Age requirement: The Service is intended for individuals 13 years of age or older. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service.
- Anonymous use: When you first use Mylo Hub, you may browse nearby posts as an anonymous user without providing personally identifiable information.
- Account creation for claiming offers: To claim an offer, you must register using Google Sign-In, Apple Sign-In, or email and password (with email verification).
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or engaged in fraudulent, abusive, or harmful behavior.
1.3 Description of the Service
- Mylo Hub displays posts from merchants and municipalities, including:
- Offers (promotions and discounts) – merchants only
- Events
- News and municipal updates
- Mylo Hub uses your device location to show relevant nearby posts. (See the Privacy Policy for details.)
- Users may claim offers from participating merchants.
- Users may share posts externally (for example, via text, email, or social media) using their device’s native sharing features.
There is currently no in-app social network (no comments, likes, or direct messaging between users).
1.4 Merchant & Municipality Accounts
Onboarding. To become a merchant or municipality on Mylo Hub, you must:
- Register a user account as described above.
- Provide full contact information (such as name, street address, city, state, ZIP, phone, and email).
- Provide business information, including business or municipality name, address, phone, email, and website URL.
- Provide business location data (e.g., latitude/longitude) to enable location-based discovery.
- Complete phone/SMS verification so we have a reliable contact number.
- Be invited and/or activated via a merchant referral code issued or approved by Barking Flea.
Municipalities. For the purposes of these Terms, municipalities are treated as a type of merchant. Municipalities may post News and Events, but may not post Offer-type posts.
Responsibility for posted content. Merchants and municipalities are fully and solely responsible for all content they post, including:
- Accuracy, completeness, and legality of their posts.
- All pricing, descriptions, and terms of offers, events, or news.
- Business information (address, contact details, hours, website, etc.).
- Honoring valid, unexpired claims according to the terms they have configured.
Barking Flea does not create, verify, or guarantee merchant or municipality content and will not be responsible for errors, omissions, inaccuracies, misrepresentations, or disputes relating to posted content, including pricing or offer terms.
We reserve the right (but have no obligation) to review, remove, or restrict access to content that violates these Terms or applicable law, and to suspend or terminate accounts that violate these Terms or are otherwise harmful to the Service or users.
1.5 Content, Ownership & Licenses
Your content. You retain ownership of content you submit or upload to the Service (“User Content”), such as business descriptions, logos, images, and posts. You are responsible for ensuring you have all rights necessary to submit and use such content in connection with the Service.
License to Barking Flea. By submitting User Content, you grant Barking Flea a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, display, and distribute such content solely to operate, promote, and improve the Service and our related offerings. We will not sell your content to unrelated third-party advertisers.
Our rights. Mylo Hub and all related software, design, trademarks, logos, and other intellectual property are owned by Barking Flea or its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for personal use (consumers) or internal business use (merchants and municipalities).
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract source code except as permitted by law.
1.6 Offer Claims & Redemption
- End users may claim offers posted by merchants through the app.
- When you claim an offer, Mylo Hub records that claim and associates it with your account and the merchant’s post.
- Offer availability, expiration, and redemption terms are configured solely by the merchant at the time they create the post.
- Merchants are generally expected to honor valid, unexpired claims in accordance with the terms shown in the app at the time of claim.
- Once an offer and associated claim have expired under the merchant’s configuration, the merchant is not obligated to honor the claim.
Barking Flea’s role. Barking Flea is not a party to any transaction or arrangement between users and merchants or municipalities. We do not set prices or terms, guarantee availability or quality of goods/services, or process payments or handle refunds between users and merchants. Any issues regarding fulfillment, quality, pricing, or redemption are strictly between you and the merchant.
1.7 Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Post, upload, or share content that is fraudulent, misleading, illegal, defamatory, obscene, pornographic, threatening, harassing, hateful, discriminatory, or infringing on third-party rights.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Use automated tools (bots, scrapers, crawlers) to access the Service except as expressly permitted by us in writing.
We may investigate suspected violations and take appropriate action, including removing content, suspending or terminating accounts, and cooperating with law enforcement.
1.8 Communications, Notifications & SMS Messaging
Note: This section is intended to clearly describe our notification practices, including opt-in and opt-out controls.
1.8.1 Types of Communications
By creating an account, using the Service, or opting into notifications within the app, you understand that Mylo Hub may send you communications via in-app notifications (push or in-app messages), email, and/or SMS text messages, including:
- Account and security-related messages (e.g., verification codes, login/security alerts).
- Offer claim confirmations, reminders, or related updates.
- Important app or service announcements.
- Merchant program or administrative communications (for merchants and municipalities).
- Marketing or promotional messages sent by Mylo Hub about participating merchants, events, or offers, where permitted by law and enabled by your preferences.
1.8.2 Promotional Messages & Data Sharing
Promotional or marketing messages sent by Mylo Hub may include information about participating merchants, events, or offers. Such messages are sent by Mylo Hub on behalf of participating merchants, and Mylo Hub does not share user contact information directly with merchants for marketing purposes.
1.8.3 Essential vs. Non-Essential Communications
- Essential Communications include account verification messages, security alerts, critical service or legal notices (such as material changes to these Terms or the Privacy Policy), and messages strictly necessary to operate the Service you have requested.
- Non-Essential Communications include marketing or promotional messages, general app news or tips, and offer reminders or suggestions.
You may be required to receive Essential Communications as a condition of maintaining an account or using certain features (for example, verification codes).
1.8.4 Opt-In for Non-Essential Email/SMS
Mylo Hub will only send non-essential email or SMS marketing/promotional communications where you have opted in, for example by enabling email and/or SMS preferences within the in-app Settings page. Consent to receive non-essential communications is not required to use core features of the Service (other than Essential Communications).
1.8.5 Managing Preferences (Opt-Out / Changes)
You can manage or disable non-essential communications at any time by:
- In-app controls: Adjust notification and marketing preferences in the Mylo Hub Settings page.
- Email request: Email support@barkingflea.com and request that non-essential SMS and/or email notifications be disabled for your account.
Requests submitted by email will be processed within a reasonable period. Disabling non-essential notifications does not affect Essential Communications, which we may still send when necessary to operate the Service or protect your account.
1.8.6 Message & Data Rates
Message and data rates may apply to SMS messages according to your mobile carrier and plan. You are responsible for any such charges.
1.8.7 Delivery of Notifications
We use reasonable efforts—together with our third-party communication providers—to deliver notifications promptly. However, we do not guarantee delivery, timeliness, or availability of notifications (including SMS, email, or push), which may be affected by device settings, operating system behavior, network availability, or third-party providers and carriers.
Mylo Hub should not be relied upon as your sole source for time-sensitive or emergency information.
1.9 Third-Party Services & Links
The Service may integrate with or contain links to third-party services and platforms such as identity providers, mapping/navigation tools, social networks, and external merchant or municipality websites. We do not control these services and are not responsible for their content, accuracy, policies, or practices. Your use of third-party services is governed by their own terms and privacy policies.
Third-party communication providers. We may use third-party providers (for example, email/SMS gateways or push notification services) to send you communications. Your information is shared with these providers only as needed to deliver such communications.
1.10 Sponsored & Promotional Content
From time to time, Mylo Hub may display sponsored posts, featured offers, or other promotional content from participating merchants or partners. Sponsored or promotional content will be clearly labeled or otherwise distinguishable within the app.
We do not sell your personal information to third-party advertisers. If we materially change this practice, we will update these Terms and the Privacy Policy and seek any required consents.
1.11 No Emergency Services
Mylo Hub is not a substitute for 911 or any emergency service, official emergency alert systems, or official government communication channels. Even if municipalities use Mylo Hub to post urgent updates, we do not guarantee timely delivery or receipt of notifications and are not responsible if you miss or do not receive an alert. For emergencies, always use official emergency channels and services.
1.12 Disclaimers
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, Barking Flea disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or free of harmful components.
- Barking Flea is not responsible for errors, omissions, or inaccuracies in merchant or municipality content, including pricing or terms.
- Barking Flea does not guarantee that any offer, event, or news item will be honored, accurate, or available when you visit a business or attempt to redeem an offer.
- Notifications: We do not guarantee the delivery, timeliness, or reliability of notifications (email, SMS, or push), which may be affected by device settings, network conditions, or third-party services.
1.13 Limitation of Liability
To the fullest extent permitted by law, Barking Flea and its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, goodwill, or other intangible losses arising out of or in connection with your use of the Service.
In no event shall Barking Flea’s total liability for all claims relating to the Service exceed the greater of: (1) the amount you paid us (if any) for use of the Service in the 12 months preceding the claim, or (2) US $50.
Some jurisdictions do not allow certain limitations of liability; in such cases, some of the above limitations may not apply to you, but our liability will be limited to the fullest extent permitted by law.
1.14 Indemnification
You agree to indemnify, defend, and hold harmless Barking Flea and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or connected with your access to or use of the Service, your violation of these Terms, your User Content, or your violation of any law or third-party rights.
1.15 Termination
We may suspend or terminate your access to the Service at our discretion, including if you violate these Terms, we believe your use may cause harm to the Service or others, or we discontinue the Service. You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy.
Upon termination, your right to access and use the Service will cease. Certain provisions will continue to apply, including ownership provisions, warranty disclaimers, limitations of liability, and indemnification.
1.16 Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the State of New Hampshire, without regard to conflict of laws principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New Hampshire, and you consent to personal jurisdiction and venue in those courts.
1.17 Changes to These Terms
We may update these Terms from time to time to reflect new features, changes to the Service, legal requirements, or operational changes. When we do, we will update the “Last Updated” date at the top of this document and may provide additional notice within the app or on our website if the changes are material. Continued use of the Service after changes become effective means you accept the updated Terms.
